Terms of Service

1. Acceptance of Terms

By accessing or using PulseAssist ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. PulseAssist reserves the right to update these Terms at any time. Continued use after changes constitutes acceptance of the revised Terms.

2. Description of Service

PulseAssist is an autonomous AI assistant that runs on your dedicated machine. The Service includes a Python backend, Next.js web dashboard, computer control capabilities, voice call functionality, social media management, and identity evolution features. The Service requires an Anthropic API key and may optionally use third-party services (Telnyx, ElevenLabs, Supabase) for additional functionality.

3. User Accounts

You must create an account to use PulseAssist. You are responsible for maintaining the confidentiality of your account credentials and API keys. You are responsible for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. PulseAssist is not liable for any loss arising from unauthorized use of your account.

4. Pricing and Payments

PulseAssist offers tiered subscription plans: Starter ($99/month), Pro ($249/month), and Business ($499/month). Each plan includes a monthly credit allocation. Usage beyond included credits is billed at the tier-specific overage rate. Payments are processed through Stripe. Subscriptions renew automatically unless cancelled. Refunds are handled on a case-by-case basis within 14 days of the billing date.

5. Acceptable Use

You may not use PulseAssist to: violate any applicable law or regulation; infringe on intellectual property rights of others; harass, threaten, or harm any person; distribute malware or engage in unauthorized access to computer systems; generate content that promotes violence, discrimination, or illegal activity; impersonate another person or entity in a deceptive manner; overwhelm or disrupt the Service through automated abuse. PulseAssist reserves the right to suspend accounts that violate these terms.

6. Data and Privacy

Your agent's data (identity, journal, conversations, task history) is stored primarily on your local machine. Cloud backup (available on Pro and Business tiers) is end-to-end encrypted with a key derived locally that never leaves your machine. PulseAssist cannot read your encrypted cloud data. Anonymized procedural knowledge may be contributed to the Collective Intelligence system, which contains zero user-identifiable data. See our Privacy Policy for full details.

7. Intellectual Property

PulseAssist and its original content, features, and functionality are owned by PulseAssist and are protected by international copyright, trademark, and other intellectual property laws. Content generated by your agent (images, text, code) belongs to you. Skills contributed to the Collective Intelligence system are licensed under a perpetual, non-exclusive license for use by all PulseAssist agents.

8. Third-Party Services

PulseAssist integrates with third-party services including Anthropic (AI), Telnyx (telephony), ElevenLabs (voice synthesis), Supabase (database/auth), and others. Your use of these services is subject to their respective terms. PulseAssist is not responsible for the availability, accuracy, or policies of third-party services. API costs for Anthropic and other services are borne by you through the credit system.

9. Computer Use and Automation

PulseAssist's Computer Use feature controls your machine's screen, mouse, and keyboard. You acknowledge that: the agent operates on your machine with the permissions you grant; you are responsible for supervising agent actions, especially during initial setup; the agent includes safety guardrails (sensitive site detection, credential protection, audit logging) but these are not infallible; PulseAssist is not liable for actions taken by the agent on your behalf. The approval tier system allows you to configure which actions require explicit consent.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PULSEASSIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICE; (B) ACTIONS TAKEN BY YOUR AGENT; (C) UNAUTHORIZED ACCESS TO YOUR DATA; (D) THIRD-PARTY SERVICE FAILURES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Termination

Either party may terminate the subscription at any time. Upon cancellation: your local data remains on your machine; cloud backups (Pro/Business) are retained for 30 days, then permanently deleted; your agent's Collective Intelligence contributions remain in the system (anonymized, non-identifiable). PulseAssist may suspend or terminate accounts that violate these Terms without prior notice.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the Australian Centre for International Commercial Arbitration (ACICA). The arbitration shall take place in Brisbane, Queensland.
